European Union (EU)* :Result of Partial Interim Reviews of the Anti-dumping Measures on Imports of Certain Products Originating in the Mainland of China

Further to Commercial Information Circular No. 117/02 of 27 June 2002, the Council of the EU has published regulations to amend the anti-dumping measures imposed on imports of certain products originating in the mainland of China consequent to the conclusion of partial interim reviews. Details of the anti-dumping measures in question and the products concerned are summarised at Annex 1 (pdf format). Copies of the regulations announcing the results of the reviews are at Annexes 2-4 (pdf format) for reference.

DETAILS

  1. The European Commission initiated on 13 June 2002 the partial interim reviews on its own initiative in order to examine the appropriateness of certain anti-dumping measures, namely in the form of a specific duty, which do not cater for situations in which imported goods have been damaged before entry into free circulation in the Community.
     

  2. As a result of the reviews, the Council of the EU decided that in cases where goods have been damaged before entry into free circulation and, therefore, the price actually paid or payable is apportioned for the determination of the customs value, the amount of the specific anti-dumping duty shall be reduced by a percentage which corresponds to the apportioning of the price actually paid or payable. The purpose is to avoid an excessive amount of anti-dumping duty being levied. The amendments have entered into force on 31 January 2003.
