European Union (EU)* : Initiation of an Expiry Review of the Anti-dumping Measures on Imports of Furfuraldehyde Originating in the Mainland of China

Further to Commercial Information Circular No. 91/2003 of 28 March 2003, the European Commission has initiated an expiry review of the anti-dumping measures in force on imports of furfuraldehyde originating in the mainland of China. A copy of the notice initiating the review is at Annex (pdf format) for reference. Salient points are set out below-

(a) Date of Notice : 18 December 2003
(b) Product Coverage : 2-furaldehyde (also known as furfuraldehyde or furfural); classifiable within CN code 2932 1200 (this CN code is given for information only).
(c) Procedures :

In view of the apparently large number of parties involved, the Commission may apply sampling technique. Exporters/producers or representatives acting on their behalf should, within 15 days from 18 December 2003, make themselves known to the Commission and provide information requested in paragraph 5.1(a) (i) of the notice in question, including contact details, turnover, activities of their company/companies, and indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation of their response. Questionnaire replies from sampled parties must reach the Commission within 37 days from the date of the notification of their inclusion in the sample.

In order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, sampled exporters/producers in the mainland of China, any association of exporters/producers, importers, any association of importers named in the request or which co-operated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

Interested parties who did not co-operate in the investigation leading to the measures subject to the present review should request a copy of the questionnaire within 15 days from 18 December 2003.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission within 40 days from 18 December 2003 unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 18 December 2003.

  1. The Commission initiated the expiry review on the basis of a request lodged by the Furfural Espanol SA. It was alleged that there would be continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.
     
  2. The existing anti-dumping duty at a rate of EUR 352 per tonne will remain valid until completion of the expiry review. Definitive anti-dumping duty on furfuraldehyde originating in the mainland of China has been imposed since 22 January 1995. Following an interim review, the duty has been extended for another four years effective from 23 December 1999.
