European Union (EU)* :Revocation of the Exemption for Certain Parties from the Payment of the Anti-dumping Duty Extended to Certain Bicycle Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 128/2003 of 3 May 2003, the European Commission (EC) has published a notice in the Official Journal of the European Union to revoke the exemption for certain parties from the extended anti-dumping duty on imports of certain bicycle parts originating in the mainland of China. A copy of the notice is attached (pdf format) for reference.

DETAILS

  1. Based on the findings of a circumvention investigation, the Council of the EU extended with effect from 19 January 1997 the definitive anti-dumping duty of 30.6% imposed on imports of bicycles originating in the mainland of China to imports of certain bicycle parts originating in the mainland of China. Bicycle assemblers in the EU could however request for exemption from the extended anti-dumping duty if they could prove, among other things, that their assembly operations did not circumvent the EU's anti-dumping duty imposed on bicycles originating in the mainland of China.
     

  2. The EC would publish and update the list of exempted parties as and when necessary. The EC was informed from various sources that a number of exempted parties have ceased to exist or have stopped assembling bicycles. Having written to seek confirmation from these parties and examined their cases, the EC decided that the exemption for these parties should be revoked and therefore published the attached notice.
