Dear Sirs,

Commercial Information Circular No. 171/2003

European Union (EU)*: Result of Partial Interim Reviews of the Anti-dumping Measures on Imports of Certain Products Originating in the Mainland of China

Further to Commercial Information Circular No. 117/02 of 27 June 2002, the Council of the EU has published regulations to amend the anti-dumping measures imposed on imports of certain products originating in the mainland of China consequent to the conclusion of partial interim reviews. Details of the anti-dumping measures in question and the products concerned are summarised at Annex 1. Copies of the regulations announcing the results of the reviews are at Annex 2 - 3 ( pdf format) for reference.

DETAILS

  1. The European Commission initiated on 13 June 2002 the partial interim reviews on its own initiative in order to examine the appropriateness of certain anti-dumping measures, namely in the form of a minimum import price, which do not differentiate between sales made to related parties and sales made to unrelated parties, or between direct sales and indirect sales to the Community. Allegedly, that can lead to enforcement problems and the measures in force do not appear sufficient to counteract the dumping which is causing injury. Also, the anti-dumping measures in question do not cater for situations in which imported goods have been damaged before entry into free circulation in the Community.

  2. As a result of the reviews, the Council of the EU decided that the sales made by exporters located in the mainland of China directly to an unrelated party in the Community shall remain subject to the minimum import price, which was found to be the appropriate measure in the original investigations. However, in order to avoid the risk of price manipulation for purpose of circumventing the anti-dumping measures, in all other cases an ad valorem duty rate shall apply. Please refer to Annex 1 for details. Also, in cases where goods have been damaged before entry into the Community and, therefore, the price actually paid or payable is apportioned for the determination of the customs value, the minimum import price shall be reduced by a percentage which corresponds to the apportioning of the price actually paid or payable. The duty payable will then be equal to the difference between the reduced minimum import price and the reduced net, free-at-Community-frontier price, before customs clearance. All amendments have entered into force on 12 June 2003.
