European Union (EU)*: Initiation of Expiry Review of the Anti-dumping Measures on Imports of Powdered Activated Carbon Originating in the Mainland of China

Further to Commercial Information Circular No. 178/2000 of 12 December 2000, the European Commission has initiated an expiry review of the anti-dumping measures on imports of powdered activated carbon originating in the mainland of China. A copy of the notice initiating the review is appended (pdf format ) to this circular for reference. Details are set out below.

DETAILS

2. (a) Date of Notice : 6 June 2001
(b) Product Coverage : Powdered activated carbon obtained from a variety of raw materials such as coal, peat, lignite, wood, olive stones or coconut shells which are activated by means of a steam or chemical process; and used for water purification purposes, treatment of waste water and by the food, chemical and pharmaceutical industries for the absorption of colours and impurities classifiable within CN code ex 3802 1000 (this code is given for information only).
(c) Procedures : In view of the apparent large number of exporters, the Commission may apply sampling technique. Exporters/producers, or representatives acting on their behalf should, within 15 days from 6 June 2001, make themselves known to the Commission and provide information requested in paragraph 5.1(a)(i) of the notice, including turnover, activities of their company/companies, indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation of their response. Questionnaire replies from sampled exporters/producers must reach the Commission within 37 days from the date of the notification of their inclusion in the sample.

n order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, sampled exporters/producers, any association of exporters/producers, importers and any association of importers named in the request or which cooperated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

All interested parties may make their views known in writing (including submitting questionnaire replies), provide supporting evidence and apply to be heard by the Commission within 40 days from 6 June 2001, unless otherwise specified.

  1. The Commission initiated the review on the basis of a request lodged by the European Chemical Industry Council (CEFIC) on 5 March 2001. It was alleged that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.

  2. The existing anti-dumping measures will remain valid until completion of the review. Current anti-dumping duty on powdered activated carbon originating in the mainland of China has been imposed since 6 June 1996. The rate of duty is ECU 323 per tonne (net weight).
