Commercial Information Circular No. 7/01

Denmark : Prohibition on Import and Marketing of Products Containing Lead

Denmark has recently adopted a Statutory Order to prohibit the import and marketing of products containing lead. A copy of the Statutory Order (the Order) is appended to this Circular for reference.

DETAILS

  1. The Order on prohibition of import and marketing of products containing lead entered into force on 1 December 2000. Major provisions are :

    1. lead shall mean the element lead, both in metallic form and in chemical compounds ;

    2. products containing lead shall mean products in which lead represents more than 100 ppm (mg/kg) of their homogeneous components. However, for lead carbonates and lead sulphates in paint, the 100 ppm "impurity" limit is not allowed;

    3. import and marketing of products containing chemical compounds of lead shall be prohibited as of 1 March 2001. However, import and marketing of products containing chemical compounds of lead as set out in Annex 1 of the Order shall be permitted until the dates stated in the said Annex;

    4. import and marketing of products containing metallic lead shall be prohibited for the product categories stated in Annex 2 of the Order as of the dates stated in the said Annex and

    5. the Order shall not apply to raw materials, semi-finished goods and import and marketing of products exclusively for export. In addition, it shall not affect the import, marketing, and the use of products containing lead that, at the time of the entry into force of the Order, are already regulated under other legislation. Such products include certain batteries and accumulators, medical devices, ceramic articles intended to come into contact with foodstuffs and packaging and packaging waste.
