Measures on Imports of Gas-fuelled, Non-refillable Pocket Flint Lighters
Originating in the Mainland of China
Further to Commercial Information Circular No. 175/99 of 11 November 1999, the European Commission has initiated an expiry review of the anti-dumping measures on imports of gas-fuelled, non-refillable pocket flint lighters originating in the mainland of China. A copy of the notice initiating the review is appended (pdf format )to this circular for reference. Details are as follows:

In view of the apparent size and complexity of the proceedings, the Commission may apply sampling technique. Exporters/ producers, or representatives acting on their behalf should, within 15 days from 5 May 2000, make themselves known to the Commission and provide information requested in paragraph 5(a)(i) of the notice, including contact details, turnover, activities of their company/companies, indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation. In order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, sampled exporters, importers, any association of exporters, sampled importers, traders and any association of traders named in the request, and the authorities of the mainland of China. All interested parties should, within 15 days from 5 May 2000, request a copy of the questionnaire from the Commission in writing indicating their name, address, e-mail address, telephone and fax, and /or telex numbers. They may make their views known in writing (including by replying to the questionnaire), provide supporting evidence and apply to be heard by the Commission within 40 days from 5 May 2000. Companies included in the sample must reply to the questionnaire within 30 days from the date of the notification of their inclusion in the sample. The Commission initiated the review on the basis of a request lodged by the European Lighters Manufacturers Federation on 3 February 2000. It was alleged that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.
- The existing anti-dumping measures will remain valid until completion of the review. Current anti-dumping duty on gas-fuelled, non-refillable pocket flint lighters originating in the mainland of China is ECU 0.065 per lighter which has been imposed since 5 May 1995. Such ant-dumping duty has been extended to gas fuelled, refillable pocket flint lighters originating in the mainland of China (of value below EUR 0.15 per price) since 30 January 1999 as a result of an anti-circumvention investigation.
