European Union (EU) : Extension of the Definitive Anti-dumping Duty on
Certain Tube and Pipe Fittings, of Iron or Steel, Originating in the Mainland
of China to Imports of the Same Products Consigned from Chinese
Taipei Whether Declared as Originating in Chinese Taipei or Not

Further to Commercial Information Circular No. 118/99 of 5 August 1999, the Council of the EU has published a regulation in the Official Journal of the European Communities to extend the definitive anti-dumping duty imposed on certain tube and pipe fittings, of iron or steel, originating in the mainland of China to imports of the same products consigned from Chinese Taipei whether declared as originating in Chinese Taipei or not. A copy of the regulation is appended (pdf format) to this circular for reference. Details are as follows:

BACKGROUND

  1. The Council of the EU imposed on 4 April 1996 a definitive anti-dumping duty of 58.6% on imports of certain tube and pipe fittings, of iron or steel, originating in the mainland of China. Following a request from the Defence Committee of the EC steel butt-welding fittings industry alleging the existence of circumvention of the anti-dumping duties by transshipment of fittings originating in the mainland via Chinese Taipei, the European Commission initiated an anti-circumvention investigation on 31 July 1999 and made the products concerned consigned from Chinese Taipei subject to registration for nine months.
     
  2. On the basis of the results of the investigation, the Commission concluded that imports of the products concerned from Chinese Taipei had circumvented and undermined the remedial effects of the anti-dumping measures imposed on imports of certain tube and pipe fittings originating in the mainland of China. The Council of the EU has therefore decided to extend the anti-dumping duty at a rate of 58.6% to imports of certain tube and pipe fittings consigned from Chinese Taipei whether declared as originating in Chinese Taipei or not (except the products produced and exported by three companies of Chinese Taipei) with effect from 15 April 2000. The duty imposed shall also be levied on imports of the products concerned which have been registered.
