European Union : Initiation of Review of the Anti-dumping Measures on Imports of Colour Television Receivers Originating in, inter alia, the Mainland of China
Further to Commercial Information Circular No. 155/99 of 14 October 1999, the European Commission has initiated an expiry and an interim review of the anti-dumping measures on imports of colour television receivers originating in, inter alia, the mainland of China. A copy of the notice initiating the review is appended (pdf format ) to this circular for reference. Details are as follows:

In view of the apparent large number of exporting producers of the product concerned, the Commission may apply sampling technique. Exporting producers, or representatives acting on their behalf should, within 15 days from 1 April 2000, make themselves known to the Commission and provide information requested in paragraph 5(a) of the notice, including contact details, turnover, activities of their company/companies, indication of agreement for being included in the sample, and confirmation of intention to submit market economy status claim form. In order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, importers, any association of exporting producers and importers named in the request, and the authorities of the mainland of China. Questionnaires will only be sent to the exporting producers following the final selection of the sample. The Commission will also send market economy status claim forms to exporting producers following selection of the sample. Exporting producers claiming market economy status should submit duly substantiated claim forms to the Commission within 21 days from the selection of sample or as determined by the Commission. Exporting producers requesting for an individual margin should, within 15 days from 1 April 2000, request a copy of the questionnaire from the Commission in writing indicating their name, address, e-mail address, telephone and fax, and/or telex number, or alternatively request the questionnaire from the authorities of the mainland of China. Such parties should however note that the Commission may decide not to grant them individual margin if it would be unduly burdensome and would prevent timely completion of the investigation. All interested parties may make their views known in writing (including by replying to the questionnaire), provide supporting evidence and apply to be heard by the Commission within 40days from 1 April 2000. The Commission initiated the review on the basis of a request lodged by the European televisions in cooperation (Poetic) on 22 December 1999. It was alleged that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures. The Commission would examine both the needs to continue with the anti-dumping measures and to revise the anti-dumping duty level under the current review.
- The existing anti-dumping measures will remain valid until completion of the review. Current anti-dumping duty on colour television receivers originating in the mainland is 44.6% of the net free-at-Community-frontier price before duty. The duty rate has been imposed since 3 December 1998 following an interim review.
