European Union (EU)1: Amendment to the Explanatory Notes to the
Combined Nomenclature of the European Communities : Footwear

 

The European Commission (EC) has recently amended the explanatory notes on certain footwear in its commodity classification system, viz. the Combined Nomenclature (CN). A copy of the amendment note is appended (pdf format) to this Circular for reference.
 

DETAILS

 

  1. The amendment aims to clarify the classification of "footwear involving special technology" and designed for sporting activity, currently included under CN headings 6402 (other footwear with outer soles and uppers of rubber or plastics), 6403 (footwear with outer soles of rubber, plastics, leather or composition leather and uppers of leather), and 6404 (footwear with outer soles of rubber, plastics, leather or composition leather and uppers of textile materials). It clarifies that footwear designed for sporting activity should be taken to mean tennis shoes, basketball shoes, gym shoes, training shoes and the like with certain exceptions. It also defines the terms used in the context of "footwear involving special technology", such as "single-moulded sole" and "multi-layer moulded sole".

  2. The amendment helps to delineate the types of Chinese origin footwear on which the EU's community quotas would apply. At present, Chinese origin footwear under CN headings 640299, 640391, 640399 and 640411 are subject to community quotas except for footwear involving special technology for use in sporting activity.
