Dear Sirs,

Commercial Information Circular No. 98/99

European Union (EU) : Result of the Review of the Anti-dumping Measures on Imports of Magnesium Oxide Originating in the Mainland of China

Further to Commercial Information Circular No. 92/98 of 30 June 1998, the Department has received information that the Council of the EU has published a regulation in the Official Journal of the European Communities to impose a definitive anti-dumping duty on imports of magnesium oxide originating in the mainland of China. A copy of the regulation is appended to this circular for reference.

DETAILS

2. The Council of the EU imposed a definitive anti-dumping duty on imports of magnesium oxide originating in the mainland of China in June 1993. The duty was the difference between the minimum price of ECU 112 per tonne and the net free-at-Community-frontier price before duty.

3. Prior to the expiry of the anti-dumping measures, the European Commission decided to initiate a review on the measures in June 1998 on the basis of a request from the Community industry. As a result of the review, the Council of the EU has decided to maintain the existing anti-dumping measures on imports of magnesium oxide originating in the mainland as follows :

  1. Product : Form of magnesium oxide, namely natural caustic calcined magnesite (CCM), processed from naturally occurring magnesium carborate or magnesite, classifiable under CN code ex 2519 9090.
  2. Rate : The difference between EUR 112 per tonne and the net, free-at-Community-frontier price before customs clearance, if the latter price is lower.
  3. Effective date : 26 June 1999
