European Union (EU) : Initiation of a Review of the Anti-dumping Measures Applicable to Certain Imports of Ring-binder Mechanisms Originating in the Mainland of China

Further to Commercial Information Circular No. 12/97 of 12 February 1997, the Department has received information that the European Commission (EC) has published a notice in the Official Journal of the European Communities to initiate a review of the anti-dumping measures on certain imports of ring-binder mechanisms originating in the mainland of China. A copy of the notice is appended to this circular for reference. Details are as follows :

DETAILS

2. (a) Date of Notice : 19 January 1999;

(b) Product Coverage : Certain ring-binder mechanisms used as fittings for loose-leaf binders or files, but excluding lever-arch mechanisms, which consist of two or more round, arched or D-shaped sturdy metal rings, classifiable within CN code ex 8305 1000 (this CN code is given for information only).

(c) Procedures : The Commission will send questionnaires to the exporters and importers known to be concerned to obtain information it deems necessary for the investigation.

Interested parties, may make their views known in writing (including by replying to the questionnaires), provide supporting evidence and apply to be heard by the Commission within 40 days from 19 January 1999.

Any interested parties which have not received a questionnaire should request one from the Commission in writing within 15 days from 19 January 1999. Their request should indicate their name, address, telephone, fax and/or telex numbers. All correspondence should be made to the following address :

3. The EC initiated the review on the basis of a request lodged by the Community producers. It was alleged that the resale and subsequent selling prices in the European Community of the product under consideration did not adequately reflect the level of the anti-dumping measures imposed.
4. The existing anti-dumping measures will remain valid until the completion of the review. The current anti-dumping duties on certain ring-binder mechanisms originating in the mainland was imposed on 25 January 1997 with rates as follows :
  • (i) for mechanisms with 17 and 23 rings -

    the difference between minimum import price of Euro 325 per 1,000 pieces and the free-at-Community-frontier not cleared through customs price; and

  • (ii) for mechanisms other than those with 17 or 23 rings -

    39.4% of the net free-at-Community-frontier price before duty except for one company (32.5%).
