Commercial Information Circular No. 86/2024

India : Final Findings on the Anti-Dumping Investigation Concerning Imports of Printed Circuit Boards (PCB) Originating in or Exported from the Mainland of China and Hong Kong

Further to the Commercial Information Circular No. 60/2023 of 16 January 2023, the Ministry of Commerce and Industry of India (hereafter referred to as the Indian Authority) published on 5 January 2024 a Notification dated 29 December 2023 announcing the final findings of the anti-dumping investigation against imports of printed circuit boards originating in or exported from the Mainland of China and Hong Kong. The Notification can be retrieved from the following website -

DETAILS

2.The final findings recommended the imposition of anti-dumping duty on printed circuit boards originating in or exported from Mainland of China and Hong Kong. Salient points of the final findings are set out below -

(a) Date of Notification : 29 December 2023
(b) Description of Goods : Printed Circuit Boards (PCB)
(c) Sub Heading of Tariff Item : India's Customs Classification No. 8534 0000
(Limited up to six-layer PCB only)
(d) Rate of Definitive Anti-Dumping Duty on Imports - :  
(i) originating in Hong Kong and exported from any place (including Mainland of China and Hong Kong)
  Duty as 30% of CIF value
(ii) originating in any place (including Mainland of China^ and Hong Kong) and exported from Mainland or Hong Kong
  Duty as 30% of CIF value
(iii) originating in Mainland of China by specified producers^ and exported from any place (including Mainland of China and Hong Kong)
  Duty as from nil to 75.72% of CIF value
(e) Effective Date : A period of 5 years from the date of notification to be issued
(f) Appeal : The Indian's Customs Tariff Act 1975 provides appeal to be filed to the Customs, Excise and Service Tax Appellate Tribunal within 90 days of the date of the Notification on 29 December 2023 (i.e. by 28 March 2024).

^ The Indian Authority provided a list of specified producers in the Mainland of China in the Notification (P.154 -156). For imports originated by any specified producer, please refer to the respective rate of definitive anti-dumping duty on the list. The Indian Customs should verify the name of the producer at the time of clearance of subject goods.
