Commercial Information Circular No. 180/2021
The Philippines : Imposition of Safeguard Measures on Certain Motor Vehicles
Further to Commercial Information Circular (CIC) No. 210/2020 dated 12 March 2020, this CIC informs that the Government of the Philippines has recently concluded the safeguard investigations and decided to impose safeguard measures on certain motor vehicles.
2.According to notification of the World Trade Organization (document symbols G/SG/N/7/PHL/12/Rev.1·G/SG/N/8/PHL/13/Rev.1·G/SG/N/11/PHL/14/Rev.1 dated 1 March 2021), the increase of import of certain motor vehicles has caused serious injury to the domestic industry in the Philippines and its Government has decided to impose safeguard measures on these products irrespective of the sources, except for those being placed on exclusion list. Salient points of the Philippines' safeguard measures on products concerned are as follows:
Product Coverage | Certain motor vehicles classified under ASEAN Harmonized Tariff Nomenclature (AHTN) Codes 8703 (passenger cars/vehicles), 8704.21.19 and 8704.21.29 (light commercial vehicles). |
Safeguard Measure | It will take the form of a cash bond amounting to (i) PHP 70,000 per unit for passenger cars/vehicles under AHTN Code 8703 and (ii) PHP 110,000 per unit for light commercial vehicles under AHTN Code 8704.21.19 and 8704.21.29. |
Effective Period | According to the Philippine Customs Memorandum Order (CMO) No. 06-2021, the imposition of safeguard measure was reckoned from the issuance of the CMO, i.e. 1 February 2021. It will last for 200 days upon the issuance of the CMO. |
That being said, relevant products of Hong Kong-origin are exempted from the abovementioned safeguard measures as Hong Kong is on the exclusion list.
