Commercial Information Circular No. 400/2020

The Philippines : Temporary Modification of Import Duty on Crude Petroleum Oil and Refined Petroleum Products

The President of the Philippines issued Executive Order No. 113 on 2 May 2020 to announce the temporary modification of import duty on crude petroleum oil and refined petroleum products with a view to funding measures that address the COVID-19 outbreak in the country.

DETAILS

2.Salient points regarding the temporary increase of import duty are set out in table below:

Product Coverage Certain products under the Harmonized System ("HS") codes 2709, 2710 and 2711. For the list of covered products, please refer to Annex A of the Executive Order - https://www.officialgazette.gov.ph/downloads/2020/05may/20200502-EO-113-RRD.pdf
Import Duty Additional import duty of ten percent on top of the current Most Favoured Nation (MFN) and preferential import duties (including those under free trade agreements) will be temporarily applied.
Effective Period The temporary modification of the import duty took effect from 4 May 2020 and will remain effective until the Republic Act No. 114691 ceases to take effect, or international oil prices have increased and reached the trigger prices (upon a certification by the Department of Energy).

1 Republic Act No. 11469 was enacted on 24 March 2020 declaring a state of emergency in the Philippines and granting emergency powers to the President of the Philippines to adopt and implement measures to address the COVID-19 outbreak. The act will be in effect for three months unless extended.
