Dear Sirs,

Commercial Information Circular No. 401/2012

The Mainland of China : Impending Expiry of Anti-dumping Measures against Imports of Methyl Ethyl Ketone from Japan, the Taiwan Province and Singapore

The Ministry of Commerce (MOC) issued Notice No. 22/2012 on 16 May 2012, announcing the impending expiry of anti-dumping measures against imports of methyl ethyl ketone from Japan, the Taiwan Province and Singapore on 21 November 2012. The relevant tariff code is 2914 1200.

DETAILS

2.According to the "Regulations on Anti-Dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement (i.e. 16 May 2012) and no later than 60 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit written applications to the MOC to request a review. The applications should include explicit review request and substantial evidence that injury would be likely to continue or recur if the duty is removed.

3.If no application for a review is submitted in accordance with the notice nor the MOC considers warrant initiating a review before the expiry date of the anti-dumping measures, the anti-dumping measures against imports of methyl ethyl ketone from Japan, the Taiwan Province and Singapore will be terminated from 22 November 2012.

4.For details of the final ruling of the subject anti-dumping cases, please refer to CIC No. 452/2007 dated 28 November 2007.
