Commercial Information Circular No. 1011/2012

The Mainland of China : Investigation on the Retroactive Levy of Duties against Imports of Solar-Grade Polysilicon from the United States, the Republic of Korea and the European Union

The Ministry of Commerce (MOC) issued Notice Nos. 40/2012 and 41/2012 on 20 July 2012 to announce the initiation of anti-dumping investigation against imports of solar-grade polysilicon from the United States and the Republic of Korea and countervailing investigation against imports of solar-grade polysilicon from the United States respectively; and issued Notice Nos. 70/2012 and 71/2012 on 1 November 2012 to announce the initiation of anti-dumping and countervailing investigations against imports of solar-grade polysilicon from the European Union. The relevant tariff code is 2804 6190, under which electronic-grade polysilicon is not covered in this investigation. Details of the cases are set out in CIC Nos. 581/2012 and 582/2012 dated 26 July 2012, and CIC Nos. 911/2012 and 912/2012 dated 7 November 2012 respectively.

DETAILS

2.MOC issued Notice No. 84/2012 on 26 November 2012 to announce the initiation of investigation on whether to levy duties retroactively against imports of solar-grade polysilicon from the United States, the Republic of Korea and the European Union. Details about the submission of information by interested parties are as follows:

  • - Manufacturers or exporters of the United States and the Republic of Korea and Mainland importers exporting solar-grade polysilicon to the Mainland during 1 July 2011 to 30 June 2012 should submit to MOC within 15 days from the date of announcement (i.e. 26 November 2012) monthly statistics on the quantity and value of the investigated products exported/imported to the Mainland from January to October 2012, and the inventory level of the Mainland importers, and submit the quantity and value of the investigated products exported to the Mainland in the previous month on a monthly basis from December 2012 until the month in which the preliminary findings of the investigation is promulgated.
  • - Manufacturers or exporters of the European Union and Mainland importers exporting solar-grade polysilicon to the Mainland during 1 July 2011 to 30 June 2012 should submit to MOC within 15 days from the date of announcement monthly statistics on the quantity and value of the investigated products exported/imported to the Mainland from May to October 2012, and the inventory level of the Mainland importers, and to submit the quantity and value of the investigated products exported to the Mainland in the previous month on a monthly basis from December 2012 until the month in which the preliminary findings of the investigation is promulgated.
