24 November 2010

Dear Sirs,

Commercial Information Circular No. 540/2010

The Mainland of China : Impending Expiry of Anti-dumping Measures against Imports of Benzofuranol from Japan, the European Union and the United States

The Ministry of Commerce (MOC) issued Notice No. 85/2010 on 22 November 2010, announcing the impending expiry of anti-dumping measures against imports of benzofuranol from Japan, the European Union and the United States. The relevant tariff code is 2932 9910.

DETAILS

  1. According to the "Regulation on Anti-dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement (i.e. 22 November 2010) and no later than 60 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit applications to the MOC to request a review. The applications should include evidence that injury would be likely to continue or recur if the duty is removed.

  1. If no application for a review is submitted in accordance with the notice nor the MOC considers warrant initiating a review before the expiry date of the anti-dumping measures, the anti-dumping measures against imports of benzofuranol from Japan, the European Union and the United States will be terminated on 12 February 2011.

  1. For details of the final ruling of the subject anti-dumping cases, please refer to CIC No. 57/2006 dated 15 February 2006.
