Commercial Information Circular No. 15/2010

India : Imposition of Definitive Anti-Dumping Duty on Flax Fabrics originating in or exported from Hong Kong and the Mainland of China

The Indian Government issued a customs notification (Annex (pdf format)) on 21 December 2009 to announce the imposition of definitive anti-dumping duty on imports of flax fabrics originating in or exported from Hong Kong and the Mainland of China.

DETAILS

  1. Traders were informed vide Commercial Information Circular Nos. 529/2008, 106/2009 and 201/2009 of the initiation of anti-dumping investigation and the imposition of provisional anti-dumping duty by the Indian government on flax fabrics originating in or exported from Hong Kong and the Mainland of China.
     

  2. The Indian government has completed the investigation and concluded that imports of flax fabrics originating in or exported from Hong Kong and the Mainland of China are taking place at dumped prices and have caused material injury to the Indian domestic industry. As a result, definitive anti-dumping duty is to be imposed with details as follows:

(a) Product Coverage : Flax Fabric falling under sub-heading 5309 of India's First Schedule to the Customs Tariff Act, 1975 which is originating in or exported from :
      (i) Hong Kong (ii) the Mainland of China
(b) Rate of Definitive Anti-Dumping Duty : Difference between 209.72 and the landed value (in Indian Rupee and per metre) Difference between 206.24 and the landed value (in Indian Rupee and per metre)
(c) Application Period : 5 years from the date of imposition of the provisional anti-dumping duty, i.e., 26 March 2009
