The Mainland of China : Impending Expiry of Anti-dumping Measures against
Imports of Dispersion Unshifted Single-Mode Optical Fiber from the United States,
Japan and the Republic of Korea

The Ministry of Commerce (MOC) issued Notice No. 49/2009 on 1 July 2009, announcing the impending expiry of anti-dumping measures against imports of dispersion unshifted single-mode optical fiber from the United States, Japan and the Republic of Korea on 1 January 2010. The relevant tariff code is 9001 1000.

DETAILS

2. According to the "Regulation on Anti-dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement (i.e. 1 July 2009) and no later than 60 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit applications to the MOC to request a review. The applications should include evidence that injury would be likely to continue or recur if the duty is removed.
    

3. If no application for a review is submitted in accordance with the notice nor the MOC considers warrant initiating a review before the expiry date of the anti-dumping measures, the anti-dumping measures against imports of dispersion unshifted single-mode optical fiber from the United States, Japan and the Republic of Korea will be terminated on 1 January 2010.
