Dear Sirs,

Commercial Information Circular No. 298/2009

India : Imposition of Provisional Anti-Dumping Duty on Plastic Processing or
Injection Moulding Machines originating in or exported from the Mainland of China

The Ministry of Finance of India has announced the imposition of provisional anti-dumping duty on imports of all kinds of plastic processing or injection moulding machines, also known as injection presses, with clamping force between 40 tonnes and 1,000 tonnes (inclusive) originating in or exported from the Mainland of China. The notification dated 12 May 2009 can be accessed at
<http://www.cbec.gov.in/customs/cs-act/notifications/notfns-2k9/cs47-2k9.htm>.

  1. In the preliminary findings, the Directorate General of Anti-Dumping & Allied Duties of India provisionally concluded that the subject goods had been exported to India from the Mainland of China below their normal values; the domestic industry had suffered material injury and the injury had been caused by the dumped imports. Anti-dumping duty was thus recommended. The preliminary findings dated 10 February 2009 is available at
    < http://commerce.nic.in/writereaddata/traderemedies/adpref_Plastic_Processing_
    Machinery_ChinaPR.htm >.

  2. After considering the preliminary findings, the Ministry of Finance of India has announced that all goods falling under tariff heading 8477 10 00 originating in or exported from the Mainland of China are subject to a provisional anti-dumping duty at the rate of 223% of the CIF value of imports of the subject goods (except for goods imported from companies specified by the Indian authority for which separate rates ranging from 76% to 223% are applied).
