Commercial Information Circular No. 529/2008

India: Initiation of Anti-Dumping Investigations on Imports of Flax Fabrics originating in or exported from Hong Kong and the Mainland of China

The Ministry of Commerce and Industry of India (hereafter referred to as the Indian Authority) has published an initiation notification dated 3 October 2008 announcing the initiation of an anti-dumping investigation against imports of flax fabrics originating in or exported from Hong Kong and the Mainland of China. The initiation notification is available on the following website:

  1. Salient points of the initiation notification are set out below - 

a) Date of initiation :  3 October 2008
(b) Product coverage :  Woven fabric having more than 30% flax content. Indicative classification code for the subject product under India's Customs Classification Number is 53.09.
(c) Period of investigation :  1 April 2007 to 31 March 2008
(d) Timing for response :

The Indian Authority has sent letters to certain known exporters inviting them to respond to the investigation by furnishing information in the form and manner prescribed in the exporters questionnaire within 40 days from the date of the letter addressed to them. The questionnaire can be downloaded from the Indian Authority's web site (http://commerce.nic.in/traderemedies/exp_questionaire.pdf). 

Other interested parties (for examples, companies who are involved in the manufacture and/or export of the subject product but who are not known to the Indian Authority) may also furnish information in the form and manner prescribed in the exporters questionnaire. The completed questionnaire should reach the Indian Authority within 40 days from 3 October 2008.

The information submitted will be used by the Indian Authority to determine whether the subject product was manufactured and/or exported to India at a dumped price and if appropriate, what amount of anti-dumping duty should be levied on the imports from the companies concerned. Interested parties who do not submit any information or submit incomplete information in response to the present dumping investigation will have the dumping duties, if eventually levied, calculated on the basis of the best information available to the Indian Authority.
