Commercial Information Circular No. 409/2008

The Mainland of China : Impending Expiry of Anti-dumping Measures against Imports of Phenol (C6H5OH) from Japan, the Republic of Korea, the United States and the Taiwan Province

The Ministry of Commerce (MOC) issued Notice No. 51/2008 on 31 July 2008, announcing the impending expiry of the anti-dumping measures against imports of phenol (C6H5OH) from Japan, the Republic of Korea, the United States and the Taiwan Province on 1 February 2009. The relevant tariff code is 2907 1110.

According to the "Regulation on Anti-dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement (i.e. 31 July 2008) and no later than 60 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit applications to the MOC to request a review. The applications should include evidence that injury would be likely to continue or recur if the duty is removed.

If no application for a review is submitted in accordance with the notice nor the MOC considers warrant initiating a review before the expiry date of the anti- dumping measures, the anti-dumping measures against imports of phenol (C6H5OH) from Japan, the Republic of Korea, the United States and the Taiwan Province will be terminated on 1 February 2009.
