India : Preliminary Findings of Anti-Dumping Investigations on Imports of Digital Versatile Discs – Recordable (DVD-R and DVD-RW) from Hong Kong, the Mainland of China and Chinese Taipei

Further to Commercial Information Circular No. 445/2007 of 23 November 2007, the Ministry of Commerce and Industry of India (the Indian Authority) has published a notification dated 16 June 2008 on the preliminary findings of anti-dumping investigations on imports of digital versatile discs-recordable (DVD-R and DVD-RW) from Hong Kong, the Mainland of China and Chinese Taipei. DETAILS

  1. The Indian Authority has initiated investigations on 20 November 2007 and after the investigations, has come to the conclusion that:

  1. the subject goods have been exported to India from the subject countries below its normal value;

  2. the domestic industry has suffered material injury; and

  3. the injury has been caused by the dumped imports from subject countries.

  1. The Indian Authority has provisionally established that the dumping margin of the subject products from Hong Kong, the Mainland of China and Chinese Taipei amounted to respectively 63.21%, 64.72% and 63.75% on a weighted average basis. The Indian Authority is of the view that imposition of provisional duty is required to offset dumping and injury pending completion of any further investigations that may be necessary. Provisional anti-dumping duties of INR3.00, INR3.06, and INR2.96 per piece on imports of subject products from Hong Kong, the Mainland of China and, Chinese Taipei respectively have been recommended, and subsequently imposed on 23 July 2008 as detailed in another notification (No. 89/2008-CUSTOMS).   2. The Indian Authority invites comments on the preliminary findings from all interested parties which would be considered in arriving at the final findings. Any such comments should reach the Indian Authority within 40 days from the date of publication of the findings:

The Indian Authority would conduct further verification to the extent deemed necessary; and disclose essential facts before announcing the final findings.

  1. As the Trade and Industry Department has only received the notification from the Indian Authority on 21 July 2008 whereas the 40 day deadline should have fallen on 25 July 2008, the Department has requested the Indian Authority to extend the deadline for submission of comments. The Indian Authority has agreed to extend the deadline to 31 August 2008 for possible submission of comments by the Department and the Optical Disc Manufacturing and Technologies Association Limited. For other interested parties including the concerned manufacturers and exporters, consideration may also be given by the Indian Authority to their submissions made during the extended period.
