Commercial Information Circular No. 445/2007

India : Initiation of Anti-Dumping Investigation on Imports of Digital Versatile Discs – Recordable (DVD-R) from Hong Kong, the Mainland of China and Taiwan

The Ministry of Commerce and Industry of India (hereafter referred to as the Indian Authority) has published an initiation notification dated 20 November 2007 announcing the initiation of an anti-dumping investigation against imports of digital versatile discs-recordable (DVD-R) from Hong Kong, the Mainland of China and Taiwan. The initiation notification is available on the following website:

  1. Salient points of the initiation notification are set out below -

    a) Date of initiation :  20 November 2007
    (b) Product coverage : Digital versatile discs-recordable of all kinds, including DVD-R, DVD+R, DVD-RW and DVD+RW. Indicative classification codes for the subject products under India’s Customs Classification Numbers are : 85232920, 85232950, 85232970, 85234040, 85234050, 85234060, 85234080, 85234090, 85238090, 85235290, 85238050, 85239010, 85239040, 85239050 and 85239090.
    (c) Period of investigation : 1 April 2006 to 30 June 2007
    (d) Timing for response :

    The Indian Authority will send questionnaires to all the known exporters and importers, who are required to submit the information relating to their manufacture and/or export of the DVD-R within forty (40) days from the date of the letter addressed to them. 

    Other interested parties (for examples, companies who are involved in the manufacture and/or export of the DVD-R but who are not known to the Indian Authority) may submit information to the Indian Authority in writing not later than forty (40) days from the date of publication of the initiation notification on 20 November 2007. The information so submitted will be used by the Indian Authority to determine whether the DVD-R were manufactured and/or exported to India at a dumped price and if appropriate, what amount of anti-dumping duty should be levied on the imports from the companies concerned. Interested parties who do not submit any information or incomplete information in response to the present dumping investigation will have the dumping duties, if eventually levied, calculated on the basis of the best information available to the Indian Authority.
