The Mainland of China : Provisions Concerning the Merger and Acquisition of Mainland Enterprises by Foreign Investors
The Ministry of Commerce, the State-owned Assets Supervision and Administration Commission of the State Council, the State Administration of Taxation, the State Administration for Industry and Commerce, the China Securities Regulatory Commission and the State Administration of Foreign Exchange jointly promulgated the revised "Provisions Concerning the Merger and Acquisition of Mainland Enterprises by Foreign Investors" on 8 August 2006, which will take effect from 8 September 2006. The Provisions govern the approval, examination, registration and declaration procedures relating to the merger and acquisition of mainland enterprises by foreign investors. A copy of the Provisions is attached at Annex (pdf format) for reference.
