Commercial Information Circular No. 337/2005

The Mainland of China : Regulations on the Application Procedures for Projects of Foreign Investment in Commercial Fields

The Ministry of Commerce has just promulgated a "Guide to Foreign Invested Enterprises Applications and Registration", in order to clarify the procedures for processing and approving applications of foreign investment in commercial fields and the submission of relevant materials. The Guide consists of the following documents:

  • Application Procedures for Projects of Foreign Investment in Commercial Fields;
  • Submissions of Application Materials for Projects of Foreign Investment in Commercial Fields;
  • Time Limits for Reviewing and Approving Applications for Projects of Foreign Investment in Commercial Fields;
  • Administrative Measures for Foreign Investment in Commercial Fields;
  • Notice of the Ministry of Commerce on Matters Relating to Registration of Foreign Trading Rights for Foreign Invested Enterprises;
  • Notice of the Ministry of Commerce on Matters Relating to Addition of Distribution Business Scope to Foreign Invested Non-commercial Enterprises;
  • Notice of the General Office of the Ministry of Commerce on Further Clarification of Procedures for the Application and Registration of Foreign Invested Enterprises and Related Review and Approval;
  • Regulations on the Establishment of Foreign Funded Companies of Investment Nature;
  • Notice of the State Administration of Taxation on Matters Relating to the Entitlement of Tax Incentives for Foreign Invested Enterprises Engaged in Both Production and Non-production Businesses; and
  • Regulations on the Application and Registration of Business Activities Relating to Processed Oil and Auto Distribution and Franchising.
