Commercial Information Circular No. 299/2005

The Mainland of China : Regulations on the Administration of Commercial Performance

The State Council issued State Council Decree No. 439 on 7 July 2005, promulgating the "Regulations on the Administration of Commercial Performance", which will take effect from 1 September 2005. According to the Regulations, investors of the HKSAR are allowed to set up performing venues in the Mainland on an equity joint venture, contractual joint venture or wholly-owned basis and to set up performance agencies on an equity joint venture or contractual joint venture basis. Performance agencies of the HKSAR are also allowed to set up branches in the Mainland. A copy of the Regulations is attached at Annex 1 (pdf format) for reference.

  2. In addition, the Ministry of Culture issued a notice concerning the implementation of the "Regulations on the Administration of Commercial Performance" on 27 July 2005. A copy of which is attached at Annex 2 (pdf format) for reference.
