The Mainland of China :Initiation of Safeguard Investigation
and Imposition of Provisional Safeguard Measures on Imports
of Certain Steel Products

The Ministry of Foreign Trade and Economic Cooperation (MOFTEC) decided on 20 May 2002 to initiate safeguard investigation on imports of 11 categories of steel products, specifically non alloy plates, non alloy sheets and coils, electrical sheets, stainless steel plates and sheets, other non alloy steel strips, non alloy wires, non alloy bars and rebars, non alloy sections, seamless pipes, welded pipes and slabs. The tariff listings of the General Administration of Customs of the products concerned are set out at Annex 1 (pdf format).

  1. All interested parties may apply for participation in the investigation within 20 days from the date of the announcement (i.e. 20 May 2002). The responsible agencies in the Mainland are the Fair Trade Bureau of MOFTEC and the Investigation Bureau of Industry Injury of the State Economic and Trade Commission.
     

  2. On 21 May 2002, the MOFTEC also announced the imposition of provisional safeguard measures on 9 categories of steel products, specificially non alloy plates, non alloy sheets and coils, electrical sheets, stainless steel plates and sheets, non alloy wires, non alloy bars and rebars, non alloy sections, seamless pipes and slabs, effective from 24 May 2002. The safeguard measures take the form of tariff rate quotas. Imports of the above steel products within the quotas will be subject to the normal tariff rate, while imports exceeding the quotas will be subject to an additional duty of 7-26%. Annex 2 (pdf format) sets out the products which are subject to the provisional safeguard measures, the respective tariff quotas and the additional tariff rates.
     

  3. The provisional measures will be valid for 180 days from 24 May 2002. Products from developing countries, which make up to less than 3% of China's imports, as well as imports from Kazakhstan, Ukraine and Belarus, will be exempt from the measures.
