US : Section 301 Tariffs on Mainland Products - Extension of 352 Reinstated Exclusions and 77 COVID-related Exclusions through 31 May 2024

Further to Commercial Information Circulars (CICs) no. 982/2022 of 19 December 2022, no. 329/2023 of 15 May 2023 and no. 632/2023 of 11 September 2023, the US Trade Representative (USTR) issued a notice on 26 December 2023 announcing the extension of 352 reinstated exclusions and 77 COVID-related exclusions through 31 May 2024.

DETAILS

2.Since July 2018, the US has imposed additional tariffs on Mainland products worth approximately US$370 billion under the Section 301 investigation in four tranches (Lists 1-3: 25%; List 4A: 7.5%). The USTR also initiated exclusion processes for stakeholders to submit requests for the exclusion of specific products from the additional tariffs and granted exclusions periodically on specific products. In September 2023, the USTR determined to extend 352 previously reinstated exclusions and 77 COVID-related exclusions through 31 December 2023. For details, please refer to CICs no. 982/2022, no. 329/2023 and no. 632/2023 of 19 December 2022, 15 May 2023 and 11 September 2023 respectively.

3.On 26 December 2023, the USTR issued a notice announcing the extension of 352 reinstated exclusions and 77 COVID-related exclusions through 31 May 2024. This notice also announces that the USTR is opening a docket on the web portal at http://comments.USTR.gov for public comments from 22 January 2024 to 21 February 2024 on whether to further extend particular exclusions beyond 31 May 2024.
