Commercial Information Circular No. 799/2023

US : Revision to Portable Fuel Container Safety Act Regulation

The United States Consumer Product Safety Commission (Commission) published in the Federal Register (FR) of 31 October 2023 a direct final rule revising the mandatory standard for portable fuel containers.

2.This direct final rule creates a new part in Portable Fuel Container Safety Act (PFCSA) Regulation to incorporate by reference of a revised voluntary standard (ASTM F3429/F3429M-23: "Standard Specification for Performance of Flame Mitigation Devices Installed in Disposable and Pre-Filled Flammable Liquid Containers" developed by ASTM International) as well as the other two voluntary standards (ASTM F3326-21: "Standard Specification for Flame Mitigation Devices on Portable Fuel Containers" and section 18 of UL 30:2022: "Standard for Safety: Metallic and Nonmetallic Safety Cans for Flammable and Combustible Liquids") which the Commission has determined to be mandatory.

3.The rule is effective on 9 December 2023. If the Commission receives a significant adverse comment by 30 November 2023, it will withdraw the direct final rule before its effective date.
