US : Section 301 Tariffs on Mainland Products – Extension of 352 Reinstated Exclusions until 30 September 2023
Further to Commercial Information Circular (CIC) no. 246/2022 of 24 March 2022, the US Trade Representative (USTR) announced on 16 December 2022 to extend the 352 reinstated exclusions for an additional 9 months until 30 September 2023.
DETAILS
2. Since July 2018, the US has imposed additional tariffs on Mainland products worth approximately US$370 billion under the Section 301 investigation in four tranches (Lists 1-3: 25%; List 4A: 7.5%). The USTR also initiated exclusion processes for stakeholders to submit requests for the exclusion of specific products from the additional tariffs and granted exclusions periodically on specific products for about one year or so. Subsequently, the USTR further extended 352 expired product exclusions until 31 December 2022.
3. On 16 December 2022, the USTR announced to extend the 352 reinstated exclusions for an additional 9 months until 30 September 2023, based on a continued consideration of factors and criteria, and also the ongoing statutory four-year review.
4. Interested persons wishing to submit comments on whether certain tariff headings with a reinstated product exclusion should remain covered by the actions or removed, may submit comments on docket number USTR-2022-0014. Comments must be submitted through the online portal (https://comments.USTR.gov) by 17 January 2023.
