US : Section 301 Tariffs on Mainland Products - Seeking Comments in Four-Year Review of Tariff Actions

Further to Commercial Information Circular No. 709/2022 dated 5 September 2022, the US Trade Representative (USTR) published a notice on 12 October 2022 seeking public comments on the effectiveness of the tariff actions taken under the Section 301 investigation. All comments must be submitted through the online portal (https://comments.ustr.gov) from 15 November 2022 to 17 January 2023.

DETAILS

2.Since July 2018, the US has imposed additional tariffs on Mainland products worth approximately US$370 billion under the Section 301 investigation in four tranches (Lists 1-3: 25% ; List 4A: 7.5%).

3.On 5 May 2022, the USTR initiated the statutory four-year review of the tariff actions taken in 2018 under the Section 301 investigation. On 2 September 2022, it announced that it had received request from domestic industry to continue the action and thus the tariffs would remain in effect. Proceeding to the next stage of the review, the USTR will review the effectiveness of the Section 301 tariffs actions and will publish details of the process separately.

4.Accordingly, the USTR published on 12 October 2022 a notice seeking public comments on (a) the effectiveness of the tariff actions taken under the Section 301 investigation in achieving the objectives of the investigation, other actions that could be taken (including actions against other products or services); and (b) the effects of such actions on the United States economy, including consumers. The comment process has the following important dates and features:

  • the online portal for submitting comments will open on 15 November 2022.
  • all comments must be submitted through the portal at https://comments.USTR.gov (Docket number: USTR-2022-0014).
  • the deadline for submitting comments is 17 January 2023.
  • to facilitate preparation of comments, USTR intends to post a copy of questions for the docket by 1 November 2022 at https://comments.USTR.gov.
