US : Continuation of Section 301 Tariffs on Mainland Products in Statutory Four-year Review

The US Trade Representative (USTR) published a notice on 2 September 2022 announcing that the additional tariffs imposed on Mainland products (Lists 1 - 4A) under the Section 301 investigation have not terminated and will remain in effect, subject to possible further modifications resulting from the statutory four-year review.

DETAILS

2.Since July 2018, the US has imposed additional tariffs on Mainland products worth approximately US$370 billion under the Section 301 investigation in four tranches (Lists 1-3: 25% ; List 4A: 7.5%).

3.On 5 May 2022, the USTR issued a Federal Register notice to initiate the statutory four-year review of the tariff actions taken in 2018 under the Section 301 investigation and provided opportunity for the representatives of domestic industries to request continuation of the tariff actions.

4.On 2 September 2022, the USTR announced that it had received over 400 requests from domestic producers and trade associations to continue the tariff actions. As a result, the additional tariffs imposed on Mainland products (Lists 1 - 4A) under Section 301 investigation have not terminated and will remain in effect, subject to possible further modifications resulting from the statutory four-year review. As the next step, the USTR will conduct a review of the tariff actions and will publish notice(s) describing the review process. The process will include seeking comments from interested persons on the effectiveness of the actions in achieving the objectives of the investigation, other actions that could be taken, and the effects of such actions on the US economy, including consumers.
