Commercial Information Circular No. 403/2022

US : Countervailing Action against Freight Rail Coupler Systems and Components from the Mainland of China : Final Determination

Further to Commercial Information Circular No. 201/2022 of 10 March 2022 regarding the preliminary determination of countervailing duty (CVD) investigation by the US Department of Commerce (DoC) against freight rail coupler systems and certain components thereof from the Mainland of China, the DoC announced in the Federal Register (FR) notice of 20 May 2022 the final determination that countervailable subsidies were being provided to producers and exporters of the Chinese products. The final estimated subsidy rate is 265.99%. The FR notice is available at: https://www.govinfo.gov/content/pkg/FR-2022-05-20/pdf/2022-10933.pdf.

2.The US International Trade Commission (ITC) will make its final injury determination no later than 45 days after DoC's final determination. If the ITC makes affirmative final injury determination, the DoC will issue CVD order. The US Customs and Border Protection will continue to suspend liquidation of the subject imports and require a cash deposit of the estimated duties for subsequent entries in accordance with the rates as set out in the final determination. However, if the ITC determines that such injury does not exist, this proceeding will be terminated, and all estimated duties deposited or securities posted will be refunded or cancelled.
