Commercial Information Circular No. 246/2022

US : Section 301 Tariffs on Mainland Products - Reinstatement of Certain Exclusions until 31 December 2022

Further to Commercial Information Circular (CIC) no. 700/2021 of 6 October 2021, the US Trade Representative (USTR) announced on 23 March 2022 to reinstate 352 product exclusions that previously were extended but had expired. The reinstated product exclusions are retroactive to 12 October 2021, and will apply through 31 December 2022.

DETAILS

2.Since July 2018, the US has imposed additional tariffs on Mainland products worth approximately US$370 billion under the Section 301 investigation in four tranches (Lists 1-3: 25% ; List 4A: 7.5%). The USTR also initiated exclusion processes for stakeholders to submit requests for the exclusion of specific products from the additional tariffs and granted exclusions periodically on specific products for about one year or so. Subsequently, the USTR further extended 549 exclusions but they already expired in April 2021.

3.On 5 October 2021, the USTR posted a notice seeking public comments on whether to reinstate the 549 product exclusions that previously were extended. For details, please refer to CIC No. 700/2021 of 6 October 2021.

4.On 23 March 2022, the USTR announced to reinstate 352 product exclusions after reviewing public comments.
