Commercial Information Circular No. 97/2021

Mexico : Elimination of Certain Exemptions from Labelling Requirements

The Ministry of Economy of Mexico has amended the regulation setting forth general rules and criteria on foreign trade to ensure effective compliance with the labelling requirements in place for a range of products subject to Mexican official standards (NOM). The amendments took effect from 1 October 2020.

DETAILS

2.The modified regulation, among others, eliminates the following exemptions from labelling requirements:

  1. goods imported for personal use and that would not be subsequently commercialised;
  2. goods that would not be sold to consumers as imported and would be used or transfer between companies for use in the provision of professional services or production processes, or imported for reconditioning or packaging processes; and
  3. certain goods imported into border areas for specific commercial activities.

The amendments cover products such as textiles and apparel, travel goods of textile materials, leather and leather products, footwear, electric and electronic products, pre packaged food and beverages, cosmetic and personal hygiene products.

3.The amendments may also require importers to present the goods for customs clearance together with proof of conformity with the labelling requirements.
