Commercial Information Circular No. 91/2020

US : Antidumping and Countervailing Actions against Fabricated Structural Steel from the Mainland of China: Final Determinations

Further to Commercial Information Circulars No. 685/2019 of 11 September 2019 and 534/2019 of 15 July 2019 respectively regarding the preliminary determinations of anti-dumping (AD) and countervailing duty (CVD) investigations by the US Department of Commerce (DoC) against fabricated structural steel from the Mainland of China, the DoC announced in the Federal Register (FR) notices on 30 January 2020 the final determinations that imports of the Chinese products were being, or were likely to be sold in the US at less than fair value; and that countervailable subsidies were being provided to producers and exporters of the products. The final estimated weighted-average dumping margins are found to be 61.71% -  154.14%, and the estimated subsidy rates are 27.34% - 206.49%. 2.  The US International Trade Commission (ITC) will make its final injury determinations no later than 45 days after DoC's final determinations. If the ITC makes affirmative final injury determinations, the DoC will issue AD and CVD orders. The US Customs and Border Protection will continue to suspend liquidation of the subject imports and require a cash deposit of the estimated duties for subsequent entries in accordance with the rates as set out in the final determinations. However, if the ITC determines that such injury does not exist, this proceeding will be terminated, and all estimated duties deposited or securities posted will be refunded or cancelled.
