US : Section 301 Tariffs on Mainland Products Worth US$34 billion - Seventh Batch of Products Excluded from Additional Tariffs

The US Trade Representative (USTR) announced on 17 September 2019 the seventh batch of products to be excluded from the additional tariffs imposed on Mainland products worth approximately US$34 billion ("List 1") under the Section 301 investigation and the official Federal Register (FR) notice was issued on 20 September 2019.  These product exclusions will be retroactive to 6 July 2018, and remain in place one year after the publication of the FR notice.  The USTR will continue to issue decisions on pending requests on a periodic basis. 

DETAILS

2.On 6 July 2018, the US imposed an additional tariff of 25% on 818 tariff lines of Mainland products worth approximately US$34 billion ("List 1") under the Section 301 investigation.  The USTR also initiated an exclusion process for stakeholders to submit requests for the exclusion of specific products from the additional tariffs.  Subsequently, the USTR announced six batches of excluded products in December 2018, March 2019, April 2019, May 2019, June 2019 and July 2019.  For details, please refer to Commercial Information Circular nos. 1163/2018, 209/2019, 300/2019, 372/2019, 440/2019 and 516/2019 dated 28 December 2018, 21 March 2019, 18 April 2019, 15 May 2019, 4 June 2019 and 9 July 2019 respectively.

3.The USTR further announced on 17 September 2019 the seventh batch of products to be excluded from the additional tariffs.  The products include 310 specially prepared product descriptions, covering heat exchangers; hydraulic powered swing; lubricating oil transfer pumps; submersible centrifugal pumps; non-submersible centrifugal pumps for liquids; certain pumps and parts of pumps; rotary compressors; filtering or purifying machinery; electric operator-riding pallet trucks; baggage carriers; counterweight castings of iron or steel; animal feeding machinery and parts; ball bearings; electric motors, DC motors and AC motors; printed circuit boards; resistance-heated glass furnaces; GPS apparatus; radio remote control apparatus; printed circuit connectors; parts and accessories for  X-ray apparatus; thermostats for air conditioning, refrigeration or heating systems; etc. 

4.These product exclusions will be retroactive to 6 July 2018, and remain in place one year after the publication of the FR notice.  The exclusions are available for any product that meets the description set out in the exclusion, regardless of whether the importer filed an exclusion request.  The USTR will continue to issue decisions on pending requests on a periodic basis.
