US : Section 301 Tariffs on Mainland Products Worth US$300 billion - Imposition of Additional 10% Tariffs on 1 September 2019

Further to Commercial Information Circular (CIC) No. 364/2019 dated 15 May 2019 regarding the US' proposed additional tariffs on Mainland products worth approximately US$300 billion (i.e. List 4) and the subsequent public comment process under the Section 301 investigation, the US President said on 1 August 2019 that the US would impose an additional 10% tariff on those Mainland imports with effect from 1 September 2019.

DETAILS

2.The US has earlier imposed additional 25% tariffs on Mainland products worth approximately US$250 billion (List 1: US$34 billion; List 2: US$16 billion; List 3: US$200 billion) under the US' Section 301 investigation against Mainland China.

3.On 13 May 2019, the US Trade Representative (USTR) further proposed an additional tariff of up to 25% on remaining Mainland products worth approximately US$300 billion (List 4). The proposed list (https://www.govinfo.gov/content/pkg/FR-2019-05-17/pdf/2019-10191.pdf) consists of 3,805 full and partial tariff subheadings and covers essentially all products not currently covered by the Section 301 tariff measures, but excludes pharmaceuticals, certain pharmaceutical inputs, select medical goods, rare earth materials, and critical minerals. Public hearings were held from 17 to 25 June 2019 and the public comment period ended on 3 July 2019. The USTR has not yet published the finalized List 4.

4.On 1 August 2019, the US President said that the US would impose an additional 10% tariff on the remaining Mainland products worth approximately US$300 billion (List 4) on 1 September 2019.

5.Our Department would closely monitor the US' formal announcement on the additional tariffs (including the finalized List 4 and whether there will be any product exclusion request mechanism) and related developments and keep the trade posted.
