Commercial Information Circular No. 357/2019

US : Section 301 Tariffs on Mainland Products Worth US$200 billion – Increase of Tariff from 10% to 25% on 10 May 2019

Further to Commercial Information Circular (CIC) No. 344/2019 dated 7 May 2019 regarding the US' planned increase of additional tariffs from 10% to 25% on certain Mainland products worth approximately US$200 billion, the US Trade Representative (USTR) announced on 9 May 2019 through a Federal Register (FR) notice that the tariff increase will be effective with respect to the Mainland goods concerned (i) entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on 10 May 2019, and (ii) exported to the US on or after 10 May 2019. Separately, the USTR will establish a process by which US stakeholders may request product exclusions from the additional tariffs.

DETAILS

2.The US had earlier postponed its plans to increase the additional tariffs from 10% to 25% on certain Mainland products worth approximately US$200 billion under the Section 301 investigation, which were originally scheduled for 1 January 2019 and subsequently extended to 2 March 2019 and further extended since then. In the past few months, both the US and the Mainland have conducted serval rounds of trade talks with a view to reaching an agreement.

3.On 5 May 2019, the US President announced that he plans to increase the additional tariffs from 10% to 25% on certain Mainland products worth approximately US$200 billion effective on 10 May 2019 (US time). For details, please refer to CIC No. 344/2019 dated 7 May 2019.

4.On 9 May 2019, the USTR issued a FR notice to announce that the additional tariffs will be increased from 10% to 25% effective with respect to the Mainland goods concerned (i) entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on 10 May 2019, and (ii) exported to the US on or after 10 May 2019. Separately, the USTR will establish a process by which US stakeholders may request product exclusions from the additional tariffs. The USTR will publish a separate notice describing the product exclusion process, including the procedures for submitting exclusion requests, and an opportunity for interested persons to submit oppositions to a request.
