6 July 2018

Dear Sirs,

Commercial Information Circular No. 659/2018

US : Section 301 Tariffs on Certain Mainland Products - Implementation Date and Guidance on Filing Entries

As set out in this Department's Commercial Information Circular No. 582/2018 of 19 June 2018, the US Administration announced on 15 June 2018 two sets of US tariff lines of Mainland products for an additional 25% tariff under the US' Section 301 investigation.   Among them, 818 tariff lines of Mainland products worth approximately US$34 billion are subject to an additional tariff of 25% with effect from 12:01 AM (US Eastern Standard Time) on 6 July 2018.

2.In relation to the implementation of the Section 301 tariffs, the US Customs and Border Protection (CBP) issued on 3 July 2018 a guidance document on the filing requirements of those Mainland products subject to Section 301 tariffs. It clarifies that the Mainland products concerned are subject to a 25% tariff, in addition to their general tariff rates. The Section 301 tariffs are based on the country of origin (i.e. Mainland China), not country of export. The guidance document also sets out the detailed entry filing requirements, etc.

3.For further details of the US' actions in response to the Section 301 investigation and the guidance document on filing entries, please refer to the relevant notices:
