Commercial Information Circular No. 466/2018

Canada : Consumer Products Containing Lead Regulations

Health Canada published a notice in the Canada Gazette Part II of 2 May 2018 the Consumer Products Containing Lead Regulations to provide further protections to children from lead exposure. The Regulations will take effect on 2 November 2018.

2.According to the Consumer Products Containing Lead Regulations, each accessible part of a consumer product containing lead must not contain more than 90 mg/kg of lead when tested in accordance with good laboratory practices. There are certain exceptions from the requirement, that each accessible part may contain more than 90 mg/kg of lead if:

  1. lead is necessary to produce an essential characteristic of the part;
  2. no alternative part containing less lead is available; and
  3. the part, when tested in accordance with good laboratory practices, does not release more than 90 mg/kg of lead.

3.Separately, the Consumer Products Containing Lead (Contact with Mouth) Regulations introduced in 2010 were repealed. For further details, please refer to the Gazette notice, which is available at http://www.gazette.gc.ca/rp-pr/p2/2018/2018-05-02/html/sor-dors83-eng.html.
