Commercial Information Circular No. 92/2016

Brazil : Provisions for Public Interest Petition in Trade Remedy Proceedings

Further to Commercial Information Circulars No. 835/2013 of 21 October 2013 regarding the administrative procedures on investigation and application of anti-dumping (AD) measures, the Brazilian government issued Resolution No. 93/2015 on 25 September 2015 announcing the provisions for public interest petition in AD measures or other trade remedy proceedings. The public interest petition with supporting documents must be submitted to the Public Interest Technical Group ("Grupo Técnico de Avaliação de Interesse Público" in Portuguese/ GTIP) by the legal representative of the petitioner. The petition must include the following information:

  1. information on the petitioner and legal representative;
  1. details of the trade remedy measure;
  1. petitioner's request, for instance, suspension or modifications of the definitive trade remedy measure and non-application of provisional trade remedy measure, with full justifications;
  1. relationship between the petitioner and the goods subject to the trade remedy measure;
  1. goods and services affected by the trade remedy measure; and
  1. any other relevant information.
