Dear Sirs,

Commercial Information Circular No. 173/2015

Argentina : Documentary Requirements for Temporary Imports of Capital Goods

The Argentine government issued Resolution No. 1/2015 on 5 January 2015 to set out the documentary requirements for temporary imports of capital goods, for analysis of their imports on domestic sectoral economic activity.

2.Interested parties to temporary import capital goods must submit the following documents to the Ministry of Industry:

  1. information of the importer;
  2. description of the goods to be imported;
  3. reasons for the request;
  4. requested timeframe for the temporary import;
  5. customs port where the imported goods will be cleared;
  6. accreditation of the legal representative or proxy submitting the application;
  7. duly certified and legalised copy of the statute;
  8. proof of registration with the Federal Public Revenue Administration;
  9. technical bibliography;
  10. certified copy of the contract attributing the ownership of the goods on behalf of a foreign party (other than the importer), and the obligation to re-export the goods to another customs territory or foreign trade zone; and
  11. pro forma invoice.

3.Once the required documents are submitted, the National Directorate for Industry will review the application and, whenever applicable, request the relevant industry associations to submit within 10 business days information on the existence of domestic production of subject goods. Should there be domestic production of subject goods, the applicant will have 10 business days to submit a response or provide any additional information. The National Directorate for Industry will then prepare a technical report and issue a final decision.

4.For details, traders are advised to consult their importers in Argentina and/or the Argentine Resolution (in Spanish) at: http://www.infoleg.gob.ar/infolegInternet/anexos/240000-244999/240829/norma.htm .
