Commercial Information Circular No. 1084/2015

Uruguay: Modifications of Requirements of Authorised Economic Operator Programme

Further to Commercial Information Circulars No. 379/2014 of 25 April 2014 regarding the establishment of Authorised Economic Operator Programme ("Programa Operador Economico Calificados" in Spanish/ OEC), the Uruguayan government issued Decree No. 242/2015 on 3 August 2015 to modify the requirements for obtaining and maintaining the OEC status.

2.The OEC applicants shall comply with the following requirements:

  • register a taxpayer identification number from the Tax Administration Department ("Dirección General Impositiva" in Spanish) and operate as a foreign trade operator for at least three years;
  • possess a consistent financial solvency with credit risk qualifications published by the Central Bank of Uruguay ("Banco Central del Uruguay" in Spanish) and liquidity ratios of the company whose minimum parameters must be determined by the Director-General of National Customs ("Dirección Nacional de Aduanas" in Spanish);
  • comply with the requirements established by the Tax Administration Department in respect of the preparation and submission of accounting statements;
  • submit a sworn declaration with details of any legal proceedings involving customs, tax or other infractions;
  • possess a history of customs and tax compliance;
  • possess an adequate administrative management that ensures the company's control over foreign trade operations; and
  • possess an adequate and documented security management system.
