Commercial Information Circular No. 980/2014

Chile : Procedures for a Request for an Advanced Customs Rulings


The Chilean government issued Exempt Resolution No. 4378/2014 on 3 September 2014 to update the procedures for a request for an advanced customs rulings by importers, exporters or manufacturers. The customs rulings request may address the following issues:
  1. tariff classification;
  2. the application of valuation methods or criteria;
  3. preferential duty treatment and originating status under a trade agreement signed with Chile;
  4. the application of rules related to the relief or exemption of imports from customs duties;
  5. refund of customs duties and other levies; and
  6. other customs matters.

2. The request must meet the following general requirements:

  1. be submitted in writing in Spanish to the Technical Branch of the National Customs Service ("la Subdirección Técnica de la Dirección Nacional de Aduanas" in Spanish) prior to the processing of such requests, specifying the registered name, identification number or taxpayer number and other contact information;
  2. provide a description of the goods in Spanish, including, whenever applicable, the composition, use, commercial and technical names, and enclosed with any information that may be necessary for the Customs to issue its determination, such as catalogues, brochures, technical specifications, photographs, reports and studies. Ruling requests for special use machinery and vehicles must also be accompanied by a manufacturer's catalogue or an appropriate technical report describing the characteristics, equipment and/or special conditioning of the good;
  3. be accompanied by a sample of the good for textiles and apparel, electronics, food, chemicals, and plastic, paper, cardboard, wood and metal products;
  4. describe the proposed customs operation and indicate the applicable legal provisions with the grounds of the request;
  5. specify whether any trade agreement or free trade agreement signed with Chile will apply to the imports; and
  6. be accompanied by a sworn declaration.

The ruling request may need to meet special requirements according to its nature as set out in paragraphs 4.2 to 4.6 of the Resolution No. 4378/2014.

3. The ruling will be issued within 90 days from the initiation of the proceedings, and valid for three years.
