Commercial Information Circular No. 505/2014

Brazil : Conformity Certification Requirements for Motorcycle Components and Gas Water Heaters

The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decrees No. 123/2014 and 186/2014 on 19 March 2014 and 14 April 2014 respectively to establish the conformity certification requirements or extend compliance dates for (a) motorcycle components; and (b) gas water heaters.

(a) Motorcycle Components

The INMETRO issued Decree No. 123/2014 to establish certain conformity certification requirements for automotive components for motorcycles, mopeds, and motorised scooters, tricycles and quads aimed exclusively at the spare parts market. The requirements will not apply to the following components:

  1. for manufacturing motorcycles, mopeds, and motorised scooters, tricycles and quads;

  1. used in vehicles due to a recall;

  1. used in vehicles whose production has discontinued prior to 31 December 2008;

  1. used in vehicles with a capacity above 450 cubic centimetres (cc);

  1. used in vehicles with a maximum power above 25 kilowatts;

  1. used in vehicles with a minimum recommended retail price of $25,000,00 real;

  1. imported as part of vehicle; and

  1. for manufacturing bikes, electric bikes, agricultural equipment and machines;

The related compliance dates are set out below:

  Compliance Date Application Criteria
(i) 24 September 2015 manufacture and import of such products
(ii) 24 March 2016 domestic sale of such products by manufacturers and importers
(iii) 24 March 2017 domestic sale of such products by all other parties

(b) Gas Water Heaters

The INMETRO issued Decree No. 186/2014 to extend the compliance dates for domestic sale of both instantaneous and accumulative gas water heaters by manufacturers and importers from 17 April 2014 to 17 October 2014, and domestic sale of such products by all parties from 17 April 2015 to 17 October 2015.
