Commercial Information Circular No. 502/2014

US : Regulations under the Fur Products Labelling Act

The US Federal Trade Commission (FTC) amended its regulations under the Fur Products Labelling Act (the "Fur Rules") to update the Fur Products Name Guide, provide more flexibility in labelling, incorporate provisions of the Truth in Fur Labelling Act of 2010, and conform the Fur Rules' guaranty provisions to those governing textile products. The amendments will take effect on 19 November 2014.

2.The Fur Rules provides the following flexibility with respect to labelling:

  1. labels should be conspicuous and of such durability as to remain attached to the product throughout any distribution, sale or resale, and until sold and delivered to the ultimate consumer;

  1. true and non-deceptive information is allowed to be included on either side of the label;

  1. information or labels should be clearly legible, conspicuous and readily accessible to the prospective purchaser; and

  1. a single label for items marketed or handled in pairs or ensembles is allowed, regardless of whether they are attached to each other at the point of sale.

3. The amended Fur Rules also:

  1. retain "Asiatic raccoon" in the Fur Products Name Guide for labelling fur products from the species nyctereutes procyonoides; and

  1. clarify that guaranties can be electronic documents but do not require the annual renewal of continuing guaranties.
