Brazil : Regulations Regarding Sunset Reviews of Anti-dumping Investigations

Pursuant to Commercial Information Circulars No. 835/2013 of 21 October 2013 and 1009/2013 of 16 December 2013 regarding the administrative procedures on investigation and application of anti-dumping (AD) measures and other aspects of AD investigations, the Ministry of Development, Industry and Foreign Trade of Brazil issued Decree No. 44/2013 on 29 October 2013 regarding sunset reviews of AD investigations.

2. Request for sunset reviews must be submitted by the domestic industry in writing four months prior to the expiry of the AD order, with supporting indications that the elimination of AD duty would lead to the recovery of dumping and injury to the domestic industry. Petitions that do not contain all the required information may be dismissed. The Department of Trade Defence ("Departamento de Defesa Comercial / DECOM" in Portuguese) may conduct on-site verification to examine the companies' record and the required information.
